Commission T.O.S
By commissioning the Artist (Lilith) the Customer acknowledges what is written in the T.O.S and agrees with the following

General

• The Artist has the right to decline a commission with no explanation needed.
• The Artist has the right to stop work on a commission due to extraordinary circumstances
• The Customer will receive the commission as a digital file nothing physical will be sent.
• None of the artworks nor the work in progress images sent by the artist may be used in AI Image data training nor be used for tracing.

Process

• The Artist will contact the Customer when ready to start the artwork.• The Customer needs to pay at least a 50% upfront inital payment before work can begin.
• The Artist will provide a sketch for approval after receiving payment.
Once the sketch is approved, the client can make 3 changes to the commission free of charge. Any changes after this limit will be an additonal 10$.• The Artist will keep the Customer updated with screenshots of the progress until completion.•The due date for the Customer paying the last 50% of their payment is 2 days after the commission is finished. If the payment is not received then the commission will be marked as canceled and the Customer will not receive the finished art, and the artist will keep the 50% upfront initial payment

Artwork Delivery

• Depending on how complex the piece is the artist can take from anywhere to 2 week to a month to complete the artwork.• When the Artwork is finished and customer pays the commission in full the Artist will send the Customer 2 files one watermarked and one with no watermark.

Payment and Refunds

• The Artist needs to be paid at least 50% upfront before work can begin.
• The Customer can pay via the commissioning platform Artistree.
• In regards to refunds they will only be given out if the artist is unable to finish the commission or the client cancels during the sketch phase.
•No Refunds will be given out for canceling after the sketch phase.

Personal-use and Commercial-use

General: The Artist retains all rights, including intellectual property rights, to the commissioned artwork. The Artist has the right to use, display, and reproduce the artwork for promotional or commercial purposes , including but not limited to, prints, merchandise, and online portfolios.Personal-Use:
• The Customer may not claim authorship of the artwork.
• If not agreed upon, the artwork is for personal use only. The Customer may not reproduce, distribute, or use the artwork for commercial purposes (for example using the art on monetized accounts)
• The Customer may post on social media platforms providing credits to the Artist.
• If the Customer requests private artwork or wishes to withhold the artist from posting publicly that needs to be stated before work begins.Commercial-Use: Commissioned artwork can be used by the Customer for commercial purposes for the fee of 50% of the total price of the commission.
• The Customer may use the artwork on monetized platforms such as Twitch and YouTube, and/or monetized accounts like twitter blue.
•The client is also allowed to make merchandise off the artwork.
•It is required to provide proper credit to the artist by including a statement like "Art by Lilith_Cat".

Adoptable T.O.S

By adopting a design from the Artist (Lilith) the Buyer acknowledges what is written in the T.O.S and agrees with the following

General

• The purchase for an adopt is for digital files only. No physical copies will be provided or shipped.

• When buying an adoptable the buyer will generally receive an unwatermarked png and a transparent png. Anything extra like a sketches will vary between adoptables.

Failure to adhere to this T.O.S may result in the buyer being blacklisted from future purchases and have usage rights revoked.

Payment and Refunds

Payments:
• Payments for an adoptable is accepted via stripe invoices in USD or payment via kofi shop.• Full payment is required within 24 hours of the invoice being sent.• Failure to pay within the 24-hour timeframe may result in the buyer forfeiting their claim along with the adoptable being relisted or sold to someone else.• In the event the buyer is unable to make the payment due to Extraordinary circumstances within the specified 24 hour period please contact the Artist via DMs within that period to see if requesting an extension is possible.

Refunds:
• All sales are final for adoptables. No refunds will be issued so the buyer must be certain that they can pay for the adoptable they choose.•If a buyer attempts a forced refund or chargeback:
They will be permanently blacklisted, and lose the usage rights to the adoptable, in which the adoptable may be relisted for sale.

Extra Policies

Reselling is permitted:
• However the resale price cannot be higher than original sale price the adoptable was bought for unless additional art is included.Design edits are allowed:• But the buyer may not claim the modified design as the original work they purchased from the artist, edits must be clearly distinguished from the original.

Trading or gifting your adoptable to another person is allowed:• However, the Artist does not track ownership transfers. It is the responsibility of both parties to ensure the new owner understands and agrees to the Terms of Service above and understand what kind of usage rights they have for the gifted adoptable, if the artist finds that the new owner has broken the terms of service then they are liable of having their usage rights revoked and getting blacklisted.• In addition to this if a buyer would like to have the commercial rights for an already purchased/gifted adopt they must Contact the artist and provide proof of ownership/purchase and then pay for the adopt's commerical use fee.
